Terms of Service

These terms are an agreement between you and TrueLabel Inc., a Wyoming corporation (“we”, “us”), for your use of PrivateGPT at privategptchat.com (the “Service”). By using the Service you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. Who can use PrivateGPT

You must be at least 18 and able to form a binding contract. You’re responsible for your account and for everything done with it, so keep your sign-in method secure.

2. The Service and plans

PrivateGPT is an AI assistant that runs open-weight models through third-party providers. The free plan includes a daily message allowance, which we may change. We may offer paid plans; their price and terms will be shown before you buy. We may change, add or remove features, models or limits at any time.

3. Acceptable use

You agree not to use the Service to:

  • break the law, or help anyone else break it;
  • harass, threaten, defraud or harm anyone, or create content that sexualizes minors;
  • infringe anyone’s intellectual property or privacy rights;
  • create malware, or attack, probe or disrupt any system, including ours;
  • get around usage limits or access controls, use automated means to access the Service, or resell it without our written permission.

We may suspend or end access for anyone who breaks these rules.

4. AI output

AI responses can be wrong, incomplete or out of date. Don’t rely on them as professional advice (including medical, legal, financial or safety advice), and check anything important before acting on it. You are responsible for how you use what the Service produces.

5. Your content

You keep ownership of what you type and of the responses generated for you, to the extent the law allows. You give us and our providers permission to process your content only as needed to run the Service. We don’t store your conversations on our servers and don’t use them to train models. Chats you save live only on your device, so we can’t recover them if they’re lost or erased.

6. Our property

The Service, including its software, design and the PrivateGPT name, belongs to us and our licensors. These terms don’t give you any right to them except to use the Service as allowed here.

7. Third-party services

The Service relies on third parties, including Google for sign-in and hosting and Together AI for the models. Their services are governed by their own terms, and we aren’t responsible for them.

8. Ending your use

You can stop using the Service and delete your account at any time from the app. We may suspend or end your access if you break these terms, if required by law, or if we stop offering the Service. Sections 4 through 11 continue to apply after your access ends.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We don’t promise the Service will be uninterrupted, error-free or secure.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Some places don’t allow these limits, so they may not apply to you.

11. Indemnity

You agree to defend and hold us harmless from claims arising from your misuse of the Service or your breach of these terms.

12. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction.

13. Changes

We may update these terms. We’ll change the date above and, for material changes, tell you in the app or by email before they take effect. Continuing to use the Service after that means you accept the new terms.
